Terms of service

The agreement between Gundesk and the businesses that use it, in plain language.

Last updated 2 November 2026

Draft for legal review. These terms have not yet been reviewed by a lawyer and are not in force.

The agreement

These terms are an agreement between [Operator legal name] (ABN [ABN]) (“we”, “us”) and the business that subscribes to Gundesk (“you”). By creating an account or using the service you accept them on behalf of that business, and confirm you are authorised to.

Gundesk is for businesses that hold, or are applying for, a firearms dealer licence, and for the people they authorise to use it.

The service and trials

Gundesk is software for keeping a dealer register, managing permits, returns and related records. A free trial lasts 30 days unless we agree otherwise. At the end of a trial you can subscribe or export your records; we do not charge you without your agreement.

Your legal obligations stay yours

Gundesk helps you meet your obligations under the Firearms Act 1996 (Vic), the Firearms Regulations 2018 (Vic) and your licence conditions, but it does not discharge them. In particular:

  • You are responsible for what is recorded in your register and for its accuracy.
  • You lodge returns and other notices with Victoria Police. Gundesk prepares the information and records your evidence; it does not lodge for you.
  • Deadlines and checks in Gundesk reflect our reading of the law at the time. Check anything you are unsure about with Victoria Police's Licensing and Regulation Division or a lawyer.
  • Keep the register available for inspection at your premises, including by printing or exporting it regularly so you are not dependent on internet access.

Gundesk is not legal advice, and it is not made, endorsed or operated by Victoria Police.

Accounts, staff and devices

  • You decide who has access and in what role, and you are responsible for what your users do.
  • Keep sign-in details secure and tell us promptly if you suspect misuse.
  • Shop tablets paired to a premises are your responsibility; revoke a device you lose.

Your data

You own the records you put into Gundesk. You give us permission to host, process and copy them only as needed to provide, secure and support the service, and as the law requires. Our privacy policy explains how we handle personal information.

You are responsible for collecting personal information lawfully, including giving your customers any collection notice the Privacy Act requires.

Acceptable use

  • Use Gundesk only for your lawful business as a firearms dealer.
  • Do not try to access another business's data, probe or disrupt the service, or work around its limits.
  • Do not upload material you have no right to hold.

Fees and payment

Fees are as shown on the pricing page or agreed with you in writing, in Australian dollars, charged monthly in advance, plus GST. We give you at least 30 days' notice of a price change. If a payment fails and is not fixed within 14 days of our notice, we may limit your account to reading and exporting records until it is.

Availability and support

We work to keep Gundesk available and to fix faults promptly, and we schedule maintenance to limit disruption. We do not promise uninterrupted service. Integrations with other services (such as an online store or cloud storage) depend on those services and their terms.

Intellectual property and confidentiality

We own Gundesk and its software. You own your records. Each of us keeps the other's confidential information confidential, except where the law requires disclosure.

Consumer law and liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where the law allows, our liability for a failure to meet a consumer guarantee is limited to supplying the service again or paying for it to be supplied again.

Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability in any 12 months is limited to the fees you paid in that period.

Ending the agreement

You can cancel at any time, effective at the end of the current billing period. We may suspend or end your access for a serious breach of these terms, after notice where practical. After the agreement ends you have 60 days to export your records, after which we delete them, except where the law requires us to keep them. Your own obligation to keep register entries for five years continues, so export them before you leave.

Changes, law and contact

We may update these terms with at least 30 days' notice of changes that affect you materially. These terms are governed by the law of Victoria, Australia. Contact us at hello@gundesk.com.au.
